REGULAR MEETING

CALL TO ORDER / PLEDGE OF ALLEGIANCE- The meeting of the City Council was called to order by Mayor John Marchand at 7:00 pm, in the City Council Chambers, 3575 Pacific Avenue, Livermore, California. 1.01 ROLL CALL - Present: Mayor John Marchand, Vice Mayor Steven Spedowfski, and Council Members Robert W. Carling, Bob Coomber, and Bob Woerner.

PROCLAMATIONS AND PRESENTATIONS 2.01 Library Board of Trustees Annual Update.

Chairperson Richard Hunt presented the update.

CITIZENS FORUM Peter Poulsen, Livermore, spoke regarding the Department of Conservation Aquifer Exemption Hearing scheduled for January 11, 2017 at the Livermore Council Chambers.

Connie Kopps, Livermore, spoke regarding Springtown and the meetings scheduled by Livermore Area Recreation and Park District.

In response to questions by Mayor Marchand, City Attorney Jason Alcala said the City had obtained a title report showing the City's ownership of the properties. He said the lead agency of the study was Livermore Area Recreation and Park District.

David McGuigan continued his allegations regarding the Police Department.

Bruce Shore, Livermore, spoke in support of a new Civic Center meeting hall at the old Civic Center Library site.

K. E. Froeschner, Livermore, spoke regarding plans for the old Lucky's shopping center site.

Jomi Coffield, Friends of Livermore, requested the City of Livermore support the litigation to prevent expansion of Carnegie SVRA into Tesla for the protection of the natural landscape in the east county.

Chuck Eyler, spoke regarding a proposed Arts Career Center that would be located next to the Bankhead Theater.

William Dunlop, Livermore, spoke regarding the development of the downtown open space that would include a hotel and conference space.

Jeff Kaskey, Livermore, spoke regarding parking options in the downtown and scheduling more community workshops to discuss the development downtown.

Jean King, Livermore, spoke in support of community workshops and in opposition to the renewal of the Exclusive Negotiating Rights Agreement with Lennar.

Jason Bezis, Lafayette, spoke in opposition of the relocation of the historic train depot.

John Stein, Livermore, spoke regarding the relocation of the historic train depot and establishing goals for the future development of the downtown.

CONSENT CALENDAR Item 4.01 Connie Kopps, Livermore, said the December 12, 2016 minutes did not list the subject matter of her comments.

ON THE MOTION OF CM COOMBER, SECONDED BY CM CARLING, AND CARRIED ON A 5-0 VOTE, THE CITY COUNCIL APPROVED THE CONSENT CALENDAR.

4.01 Approval of minutes - December 12, 2016 City Council meeting.

4.02 Resolution 2017-001 authorizing execution of an amendment to the Sales Tax Reimbursement Agreement with Shoppes at Livermore LLC, assigning its rights to Livermore Investments LLC and extending the development's opening date to no later than December 31, 2018.

4.03 Resolution 2017-002 accepting Annual Report for Community Facilities District 2006-1 for FY 2015-16.

4.04 Resolution 2017-003 approving the City of Livermore Salary Plan as of January 9, 2017 in accordance with California Code of Regulations, Title 2, Section 570.5.

4.05 Resolution 2017-004 approving the Tow Service Franchise Fee Schedule.

5. PUBLIC HEARINGS - None.

MATTERS FOR CONSIDERATION 6.01 Appointment to Oversight Board for Successor Agency to the Livermore Redevelopment Agency.

Recommendation: Staff recommends the Mayor appoint to the Oversight Board for Successor Agency to the Livermore Redevelopment Agency.

Mayor Marchand was appointed to the Oversight Board. 7.

COUNCIL COMMITTEE REPORTS AND MATTERS INITIATED BY CITY MANAGER, CITY ATTORNEY, STAFF AND COUNCIL MEMBERS 7.01 Council Committee Reports and Matters Initiated by City Manager, City Attorney, Staff, and Council Members.

Livermore Cultural Arts Council CM Woerner said on January 4, 2017, he attended the meeting. There was a presentation on creating an Art Career Center in Livermore and a discussion on the space needs for performing arts.

Downtown Development CM Woerner requested and received consensus from the City Council on renewing Matters Initiated from 2016 on the following items:

Mill Square Park/Livermorium Plaza

Bankhead Plaza Shade Structure

Lighting options for J, K, Second and Third Streets in the Downtown area.

Downtown Parking Garage and Traffic/Circulation Analysis

Establishment of a three story height limit for residential projects in the Downtown Specific Plan.

Safety Services CM Coomber suggested a review of the budget to identify resources for additional police and fire personnel to support the future population growth.

Community Workshops CM Carling requested the scheduling of a series of community workshops regarding the future development of the downtown.

Wheels VM Spedowfski said on January 9, 2017, he attended the Wheels Board of Directors meeting. He said there was a presentation of the project, Go Dublin. He said this demonstration project partially funded by ACTC and in conjunction with Uber and Lyft, provided transportation to low ridership routes.

Tesla Park VM Spedowfski requested and received consensus from the City Council to direct the City Attorney to options to support litigation regarding Tesla Park.

City Attorney Jason Alcala said there would be a Closed Session scheduled at the January 23, 2017 City Council meeting for discussion on the Tesla litigation.

Department of Conservation Mayor Marchand spoke regarding the upcoming aquifer exemption hearing scheduled on January 11, 2017 at the Livermore Council Chambers. He said as a water quality chemist specialist, he would do everything within his power to ensure the drinking water would be protected.

Oath of Office Mayor Marchand said on December 18, 2016, he attended the swearing in ceremony for Supervisor Scott Haggerty.

Mendenhall Choir Mayor Marchand said on December 19, 2016, he attended the performance of David Benoit and the Mendenhall Choir.

Menorah Lighting Mayor Marchand said on December 24, 2016, he lighted the menorah located in the downtown.

Altamont Corridor Express (ACE) Mayor Marchand said on January 6, 2017, he attended the Board meeting.

Alameda County Transportation Commission (ACTC) Mayor Marchand said on January 9, 2017, he attended the meetings. He said the I-580 Express Lane averages 31,000 cars daily and has generated over $6.4 million. There was also a discussion on the allocation bridge tolls and the reinstatement of the provisions delegating responsibility to CalTrans to complete the review of transportation projects.

Mayor Marchand adjourned the meeting in memory of Margaret Tracy, former Zone 7 Water Board Member.
