CALL TO ORDER / PLEDGE OF ALLEGIANCE - The meeting of the City Council was called to order by Mayor John Marchand at 7:02 pm, in the City Council Chambers, 3575 Pacific Avenue, Livermore, California.

1.01 ROLL CALL - Present: Vice Mayor Bob Woerner, and Council Members Robert W. Carling, and Steven Spedowfski. Mayor Marchand and Council Member Bob Coomber were absent/excused.

CITIZENS FORUM

Rachael Snedecor, Livermore Downtown Inc., thanked Council for their work on the Downtown plan.

Anne Coll, Livermore, spoke about the 2nd Annual Rally for Love to be held February 11, 2018 at Asbury United Methodist Church, from 1:30 - 3:00 pm.

Greg Scott, Livermore, spoke about homeless issues and concerns in Livermore.

David McGuigan, Livermore, stated he would reserve his comments for Mayor Marchand.

Nancy and Gary Harrington, Pleasanton, spoke in support of an interpretive pavilion at Shadow Cliffs.

Jay Davis, Livermore, spoke favorably about the City's Downtown vision and discouraged an arts center and additional parking near the Bankhead.

Jan Brovont, Livermore, spoke regarding a larger venue for the January 29, 2018 meeting.

David Rounds, Livermore, commented regarding the Downtown concepts released by the City and spoke about a more iconic and grand vision.

Alan Burnham, Livermore, spoke in support of open space and Stockmen's park with surrounding arts and science assets in the Downtown plan.

Jacob Anderson, Livermore, spoke in support of the City's Downtown plans.

Evan Branning, Livermore, spoke in support of the City's Downtown plans and moving forward.

Pablo Camargo, Livermore, spoke regarding bringing high-speed fiber internet to Livermore.

Tamara Reus, Livermore, spoke regarding a larger venue for the January 29, 2018 meeting.

Michael Fredrich, Livermore, spoke regarding a larger venue for the January 29, 2018 meeting.

Lisa Tromovitch, Livermore, spoke favorably regarding the City's process for public engagement, in support of the City's Downtown plans, and her research on small theaters and performance spaces in small communities.

John Stein, Livermore, spoke about the One Bay Area Plan successes and failures.

Dawn Argula, CEO and President, Livermore Chamber of Commerce, spoke in support of the next phase of the revitalization of the Downtown and the City's plans.

Karl Wente, Livermore, spoke regarding good government and the dissemination of false information.

Asa Strout, Build Downtown Now, spoke regarding outreach to citizens who did not participate in previous outreach events, a measure to ensure that City funds are not used where they shouldn't be in the development of the Downtown, and benches by Panama Bay Coffee Shop.

ON THE MOTION OF CM SPEDOWFSKI, SECONDED BY CM CARLING, AND CARRIED ON A 3-0 VOTE, THE CITY COUNCIL APPROVED THE CONSENT CALENDAR, WITH THE EXCEPTION OF ITEM 4.02 REMOVED FOR SEPARATE ACTION.

4.01 Approval of minutes - December 11, 2017 regular City Council meeting and January 8, 2018 regular City Council meeting.

ON THE MOTION OF CM CARLING, SECONDED BY CM SPEDOWFSKI AND CARRIED ON A 3-0 VOTE, THE CITY COUNCIL APPROVED CONSENT CALENDAR ITEM 4.02 AND ADOPTED THE FOLLOWING ORDINANCE.

4.02 Adoption of ordinance 2066 amending Livermore Municipal Code Chapter 2.14 Elections.

4.03 Ordinance introduced amending Municipal Code Section 2.68.430 Surplus Supplies and Equipment, to grant the City's Administrative Services Director the authority to surplus badges assigned to employees of the Livermore Police Department who resign in good standing following ten or more years of service with the City.

4.04 Resolution 2018-003 accepting for permanent maintenance and releasing of security for the 2017 Storm Damage Repairs, Project No. 2017-25.

4.05 Resolution 2018-004 rejecting all bids for the Water Reclamation Plant Hypochlorite Mixing Structure Replacement, Project No. 2012-13.

4.06 Resolution 2018-005 establishing speed limits on fifteen roadway segments in the City of Livermore as recommended in the Engineering and Traffic Surveys report.

4.07 Resolution 2018-006 authorizing and ratifying an application for, and commitment of up to $6,706,495 of the City of Livermore's base city allocation of Alameda County Measure A1 Countywide Housing Bond to finance the construction of the Chestnut Square Family Apartments, an affordable rental housing project.

PUBLIC HEARINGS

5.01 Hearing to consider a request by the United States Department of Energy Western Area Power Administration, for an out-of-area service agreement to allow its Patterson Pass Road substation to connect to the City's sanitary sewer and water systems. The requested sewer and water service would only serve an existing non-operational restroom facility at the substation for use by substation employees providing emergency and routine maintenance of the facility.

Recommendation: Staff recommended the City Council adopt a resolution authorizing execution of the out-of-area service agreement with the United States Department of Energy, Western Area Power Administration, to provide sanitary sewer and potable water service to the Lawrence-Livermore Laboratory substation located at 8421 Patterson Pass Road.

ON THE MOTION OF CM SPEDOWFSKI, SECONDED BY CM CARLING AND CARRIED ON A 3-0 VOTE, THE CITY COUNCIL ADOPTED THE FOLLOWING RESOLUTION.

Resolution 2018-007 authorizing execution of Out of Area Service Agreement 16-004 with the United States Department of Energy, Western Area Power Administration to provide sanitary sewer and potable water service.

5.02 Hearing to consider pre-zoning the Concannon Winery property to Planned Development 17-003 to establish development and land use standards that are appropriate to the winery site and will become the zoning for the property upon annexation.

ON THE MOTION OF CM SPEDOWFSKI, SECONDED BY CM CARLING AND CARRIED ON A 3-0 VOTE, THE CITY COUNCIL ADOPTED THE FOLLOWING RESOLUTION AND INTRODUCED THE FOLLOWING ORDINANCE.

Resolution 2018-008 finding the pre-zoning of the Concannon Winery (APNs 099-1200-001-00, 099-1200-002-00, 099-1200-003-00) as part of the annexation process is categorically exempt from the provisions of the California Environmental Quality Act.

Ordinance introduced establishing the Planned Development-Commercial (PD-C) 17-003 Zoning Standards for the Concannon Winery (APZ16-002).

MATTERS FOR CONSIDERATION

6.01 Emergency Operations Plan for the City of Livermore.

Recommendation: Staff recommended the City Council adopt a resolution approving the Emergency Operations Plan for the City of Livermore.

Emergency Operations Manager Tracy Hein presented the staff report.

Greg Scott, spoke regarding sheltering large amounts of people in an emergency, a backup plan for the water supply, and loss of power.

ON THE MOTION OF CM CARLING, SECONDED BY CM SPEDOWFSKI AND CARRIED ON A 3-0 VOTE, THE CITY COUNCIL APPROVED THE RECOMMENDATION AND ADOPTED THE FOLLOWING RESOLUTION.

Resolution 2018-009 adopting the Emergency Operations Plan for the City of Livermore.

COUNCIL COMMITTEE REPORTS AND MATTERS INITIATED

7.01 Council Committee Reports and Matters Initiated by City Manager, City Attorney, Staff, and Council Members.

STOPWASTE.ORG CM Carling attended the meeting.

Community Monitoring Committee CM Carling attended the meeting where the Altamont Landfill requirements were discussed.

Community of Character Collaborative Ceremony for Martin Luther King CM Carling attended the breakfast event on behalf of the Mayor, where legacy awards were given.

Tri-Valley San Joaquin Regional Rail Group CM Spedowfski said he and Mayor Marchand attended the first meeting on January 10, 2018.

Tri-Valley Transportation Commission (TVTC) CM Spedowfski attended the meeting on January 22, 2018 where the last phase of the Highway 84 extension was approved.

Livermore-Amador Valley Transit Authority Projects and Services Committee (LAVTA) CM Spedowfski attended the meeting on January 22, 2018 where the depot refurbishment was discussed.

Intergovernmental Meeting VM Woerner attended the meeting where emergency preparedness was discussed.

Altamont Landfill Open Space Account Advisory Committee VM Woerner stated that he did not attend the meeting, but provided direction on moving forward with the process of getting a consultant to assist with prioritizing land acquisition strategy

VM Woerner requested staff provide information on a strategy for high-speed internet.
