REGULAR MEETING

1. CALL TO ORDER/PLEDGE OF ALLEGIANCE - The meeting of the City Council was called to order by Mayor John Marchand at 7:03 pm, in the City Council Chambers, 3575 Pacific Avenue, Livermore, California.

1.01 ROLL CALL - Present: Mayor John Marchand, Vice Mayor Laureen Turner, and Council Members Stewart Gary, Steven Spedowfski, and Bob Woerner.

1.03 REPORT OF ACTION TAKEN IN CLOSED SESSION

City Attorney Jason Alcala said there was no reportable action.

2. PROCLAMATIONS AND PRESENTATIONS - None.

3. CITIZENS FORUM Nancy Rodrigue, Livermore, spoke regarding Save Tesla Park, presented materials for Council review, and requested the City Council send a letter of support for the preservation of Tesla Park.

Don Meeker, Livermore, presented historical information on matters being considered by the Board of Trustees on February 2, 1914. He also announced the Rotary Foundation Bella Rosa Ball to be held on February 14, 2015.

John Shirley, Livermore, spoke in support of the preservation of Tesla Park.

In response to questions by Mayor Marchand, Community and Economic Development Director Stephan Kiefer said the draft environmental impact report had not been released yet. He said the anticipated release date was summer 2015.

Michael Costa, Livermore, spoke regarding traffic problems on Vancouver Way and asked for the Citys support in traffic mitigation measures.

John Stein, Livermore, said the City should review and update several policies including transit oriented development, mixed use, and in-fill.

Derek Baker, spoke regarding a Police One article written by a Livermore police office that did not support the use of medical cannabis.

Chris Phillips, Livermore, spoke regarding police activity at his home in July 2014 and stated he was within his legal limit of medical cannabis. He said Livermore needed an ordinance for safe access.

Jacqueline McGowan, Livermore, said she represented The Human Solution International and was providing Chris Phillips with legal assistance. She said supporting medical cannabis was not being a stoner or part of a hippie movement.

4. CONSENT CALENDAR Item 4.03 Peter Richert, President, International Association of Fire Fighters, Local 1974, expressed appreciation to the Council and staff for the professionalism during contract negotiations.

ON THE MOTION OF CM GARY, SECONDED BY CM WOERNER, AND CARRIED ON A 5-0 VOTE, THE CITY COUNCIL APPROVED THE CONSENT CALENDAR.

4.01 Approval of Minutes - January 12, 2015 regular City Council meeting.

4.02 Resolution 2015-005 accepting the Fiscal Year 2013-2014 Single Audit Report and Memorandum on Internal Control and Required Communications.

4.03 Resolution 2015-006 approving the Memorandum of Understanding between the Livermore-Pleasanton Fire Department Joint Powers Authority and the International Association of Fire Fighters, Local 1974.

4.04 Resolution 2015-007 authorizing the second amendment of the license agreement with the Alameda County Flood Control and Water Conservation District, Zone 7, for installation of a seasonal diversion structure at the Springtown Golf Course.

4.05 Resolution 2015-008 authorizing the purchase of a replacement articulating telescopic aerial lift truck from Altec Industries, in an amount not to exceed $171,787, through an authorized cooperative purchasing agreement.

4.06 Resolution 2015-009 accepting for permanent maintenance and releasing of security for the 2014 Slurry Seal, Project No. 2014-04.

4.07 Resolution 2015-010 accepting for permanent maintenance and releasing of security for the 2014 STP Arterial Street Rehabilitation, Project No. 2014-17.

5. PUBLIC HEARINGS - None.

6. MATTERS FOR CONSIDERATION

6.01 Discussion and direction regarding City Council appointments to Intergovernmental Agencies. None.

6.02 Discussion and direction regarding execution of an amendment to the agreement with ICF Jones and Stokes, in the amount of $99,990, for preparation of additional environmental permit documentation and coordination for the City-Wide Routine Culvert, Outfall and Stream Maintenance Project (Routine Maintenance Permit Program), Project No. 2013-23.

Recommendation: Staff recommended the City Council adopt the resolution.

Associate Civil Engineer Pam Lung presented the staff report.

In response to questions by Mayor Marchand, Ms. Lung confirmed that some roads did not have storm drains but did have the curb/gutter system in addition to bioswales. She also confirmed that the City was participating in the Living Arroyos program for tree planting.

ON THE MOTION OF VM TURNER, SECONDED BY CM WOERNER AND CARRIED ON A 5-0 VOTE, THE CITY COUNCIL ADOPTED THE FOLLOWING RESOLUTION:

Resolution 2015-011 authorizing execution of an engineering design services agreement amendment with ICF Jones and Stokes, Inc., in the amount of $99,990, for a total agreement amount of $349,990, for the preparation of additional environmental permit documentation and coordination for the City-Wide Routine Culvert, Outfall, and Stream Maintenance Program, Project No. 2013-23.

6.03 Discussion and direction regarding execution of a ground lease agreement with the Livermore Heritage Guild for management of the Hagemann Farm property and appropriation of up to $42,000 for oversight, repairs, maintenance and insurance on the property. Location: 455 Olivina Avenue.

Recommendation: Staff recommended the City Council adopt the resolution.

Human Services Program Manager Jean Prasher presented the staff report.

Mayor Marchand invited public comment.

Jeff Kaskey, Livermore Heritage Guild, spoke in support of the contract. He presented an overview of the activities and accomplishments of the Guild. He said this would be a long term project and was looking forward to making progress reports soon.

VM Turner spoke in support of approval of the contract.

CM Gary said he supported the Heritage Guild taking a long stewardship of the property.

Barbara Sorensen, Livermore, spoke in support of the adaptive riding program at Hagemann Farms and said the City should spend the funds on restoring the program.

In response to questions by Mayor Marchand, Community and Economic Development Director Stephan Kiefer said the primary objective for the contract with the Heritage Guild was to preserve the site and to restore programing. He said Council soon would be requested to approve a request for proposal (RFP) for a variety of therapeutic programs at Hagemann Farms.

ON THE MOTION OF CM GARY, SECONDED BY CM SPEDOWFSKI AND CARRIED ON A 5-0 VOTE, THE CITY COUNCIL ADOPTED THE FOLLOWING RESOLUTION:

Resolution 2015-012 approving the contract for the Livermore Heritage Guild to manage the Hagemann Farm property.

6.04 Police Department Update.

Recommendation: The report was for information only.

Police Chief Michael Harris presented the report on the Area Command Policing Model. He reviewed the components and benefits of the program.

CM Gary said he would appreciate receiving the performance metrics as described in the presentation to assist with future budgeting for the Police Department.

In response to questions by CM Woerner, Chief Harris said the area commands had been established and were in working format. However, the program was being refined and he estimated the online version would be ready in the next few months, with the program fully implemented by the end of summer 2015.

In response to questions by Mayor Marchand, Chief Harris said the City had 90 sworn police officers with only three vacancies.

The City Council received the report.

6.05 Discussion and direction regarding pending State or Federal legislation. None.

7. COUNCIL COMMITTEE REPORTS AND MATTERS INITIATED BY CITY MANAGER, CITY ATTORNEY, STAFF AND COUNCILMEMBERS

7.01 Council Committee Reports and Matters Initiated by City Manager, City Attorney, Staff, and Council Members.

League of California Cities (LOCC) CM Spedowfski said from January 14-16, 2015, he attended the New Mayor and Council Member Academy in Sacramento.

Tri-Valley Transportation Commission (TVTC) CM Spedowfski said on January 26, 2015, he attended the meeting where there was discussion regarding funding allocations for the widening of Highway 84 from Concannon to Ruby Hill.

Livermore-Pleasanton Fire Department Joint Powers Authority (LPFD-JPA) CM Gary said on January 26, 2015, he attended the meeting.

Traffic Calming In response to comments made during Citizens Forum, the City Council requested staff prepare a memorandum to provide comprehensive background information on the Citys traffic mitigation programs.

Tesla Park CM Woerner said the City Council should take an official position on Tesla Park in advance of the draft environmental impact report. He requested and received support from VM Turner and CM Spedowfski to direct staff to prepare a memorandum on the timing and impact.

Citizen of the Year Awards Dinner VM Turner said on January 24, 2015, she attended the Lions Club event where Nancy OMalley received the award.

Bella Rosa Ball VM Turner announced the Rotarian Foundation of Livermore would host a Valentines Day fundraiser on February 14, 2015, 6:00 pm, at Garre Winery to support the Axis Community Health Center.

Leo Croce Elementary School Mayor Marchand said on January 13, 2015, he spoke to one hundred third-grade students.

Alameda County Mayors Conference Mayor Marchand said on January 14, 2015, he attended the event where Alameda County Supervisor Scott Haggerty presented an update on the Plan Bay Area, which tied transportation dollars to development.

Local Agencies Formation Committee (LAFCo) Mayor Marchand said on January 15, 2015, he attended the Policies Subcommittee meeting and the regular LAFCo meeting, where there were municipal service reviews on flood controls.

Marriage Ceremony Training Mayor Marchand said on January 16, 2015, he and City Clerk Susan Neer received training from the Alameda County Clerk-Recorders Office to perform civil marriage ceremonies.

United States Conference of Mayors Mayor Marchand said he attended the conference in Washington, DC, from January 21-23, 2015. He said in addition to several workshops, the five tri-valley mayors met with local, state and federal representatives to discuss topics of regional importance. He also participated in a White House program for homeless veterans.
