REGULAR MEETING

1. CALL TO ORDER - The meeting of the City Council was called to order by Mayor John Marchand at 7:04 pm, in the City Council Chambers, 3575 Pacific Avenue, Livermore, California.

1.01 ROLL CALL - Present: Mayor John Marchand, Vice Mayor Laureen Turner, and Council Members Stewart Gary and Bob Woerner. Council Member Steven Spedowfski was absent/excused.

1.02 PLEDGE OF ALLEGIANCE The Cresta Blanca Girl Scouts led the Pledge of Allegiance.

2. PROCLAMATIONS AND PRESENTATIONS

2.01 Proclamation declaring March 2015 American Red Cross Month.

Mayor Marchand presented the proclamation to Board Member Gregory Portillo declaring March 2015 American Red Cross Month.

2.02 Proclamation declaring March 8 - March 14, 2015 Girl Scout Week.

Mayor Marchand presented the proclamation to the Cresta Blanca Girl Scouts declaring March 8 - March 14, 2015 Girl Scout Week.

3. CITIZENS FORUM

Marguerite Rosendin and Collin Rogers, Youth Advisory Commissioners, presented the new Livermore Area Youth Advisory Commission logo for Council review.

David Williams, Livermore, spoke regarding the need to provide services to residents by using current vacant business parks.

Jacqueline McGowan, Livermore, spoke regarding activities and programs involving medicinal cannabis at the Tree of Life.

Don Meeker, Livermore, provided a historical overview of building permits and the first permit issued in 1908. He suggested that Baughmans be included on the historic resource inventory.

John Stein, Livermore, spoke regarding the City hiring a city architect and the rationing of building permits in the valley because of the drought.

4. CONSENT CALENDAR

Item 4.04 City Attorney Jason Alcala said Appendix 1 to the Tri-Valley Tourism Market District Plan required an amendment due to new provisions set forth by AB 2618 effective January 2015 to the Property and Business Improvement District of 1984 Act.

Mayor Marchand said he wanted to establish a sub-committee to review and discuss additional opportunities that could be included in the Plan to make the Visitors Bureau more inclusive.

MAYOR MARCHAND REMOVED ITEM 4.04 FROM THE CONSENT CALENDAR AND CONTINUED THE ITEM TO THE APRIL 13, 2015 CITY COUNCIL MEETING.

ON THE MOTION OF CM GARY, SECONDED BY VM TURNER, AND CARRIED ON A 4-0 VOTE, THE CITY COUNCIL APPROVED THE CONSENT CALENDAR.

4.01 Approval of Minutes - February 11 and February 19, 2015 special City Council meetings, and February 23, 2015 regular City Council meeting.

4.02 Adoption of Ordinance 2017 Levying Special Tax within Community Facilities District No. 2015-1. (Brisa Maintenance)

4.03 Resolution 2015-024 approving the West Jack London Boulevard Widening, Project No. 2015-28, for inclusion into the Capital Improvement Program 2014-2015 budget and appropriating $325,000 in General Funds in Fiscal Year 2014-2015 to the project.

4.04 Resolution authorizing renewal of the Tri-Valley Tourism Marketing District.

ITEM 4.04 WAS CONTINUED TO THE REGULAR CITY COUNCIL MEETING ON APRIL 13, 2015.

4.05 Resolution 2015-025 declaring non-complying parcels a public nuisance requiring abatement, directing staff to proceed with the 2015 fire Hazard Abatement Program, and setting a public hearing date of April 27, 2015.

5. PUBLIC HEARINGS - None.

6. MATTERS FOR CONSIDERATION

6.01 Discussion and direction regarding City Council appointments to Intergovernmental Agencies.

Mayor Marchand and Council Member Gary were appointed to the City Council Subcommittee to discuss the Tri-Valley Tourism Marketing District.

6.02 Discussion and direction regarding the 2015 Livermore State Legislative Platform.

Recommendation: Staff recommended the City Council adopt a resolution approving the 2015 Livermore State Legislative Platform.

Senior Management Analyst Donna Pontau presented the staff report.

In response to questions by CM Woerner, City Manager Marc Roberts said the legislation pertaining to fiscal stability and pensions would cover a multitude of issues. He said staff would continue to monitor legislation in accordance with the Councils direction for clearly identifying the obligation, establishing the payment method, and implementing the system.

In response to questions by CM Woerner pertaining to Housing, Planning and Sustainability, Mr. Roberts said each year there were numerous CEQA bills introduced and staff would continue to monitor the legislation.

In response to questions by CM Woerner pertaining to Water, Mr. Roberts said Council would be supporting, in conjunction with the other Tri-Valley cites, water wholesalers and retailers and the development of a project to improve conveyance through or around the Delta, rather than a specific plan or proposal.

With regards to item four in City Local Control, VM Turner requested stronger language in the legislations regarding RDA dissolution that ensures fair and equitable treatment to cities and successor agencies. VM Turner also supported AB 266 - Medical Marijuana.

Mayor Marchand invited public comment.

John Stein, Livermore, said actual dollar amounts should be included in the legislation pertaining to public pensions and other post-retirement benefits. He also spoke regarding recycling water and groundwater management.

In response to questions by Mayor Marchand, Mr. Roberts said legislation was for greater transparency and not the actual costs. He said this item was the legislative platform and adding a monetary amount did not fit the structure. He said the monetary amounts were included in the Citys annual budget.

ON THE MOTION OF VM TURNER, SECONDED BY CM WOERNER AND CARRIED ON A 4-0 VOTE, THE CITY COUNCIL ADOPTED THE FOLLOWING RESOLUTION:

Resolution 2015-026 supporting the adoption of 2015 Livermore State Legislative Platform.

6.03 Results of the 2014 National Citizen Survey.

Recommendation: The report was for informational purposes only. No action was required.

Assistant City Manager Jenny Haruyama presented the staff report.

Mayor Marchand said he was impressed that confidence in local government was reflected in the 68% favorable rating while recent polls showed the State received a 65% confidence rating and federal government was in the single digit. He said the results showed great work by all involved.

VM Turner said the survey showed the entire city was interested in improvement to the area north of the freeway. She was concerned about the low numbers for housing in the downtown. She expressed appreciation for the hard work and effort by City staff.

CM Woerner said the results were spectacular and the results were improving across the board. He said the results were consistent with the Councils goals and priorities, past and present.

THE CITY COUNCIL RECEIVED THE REPORT.

7.01 Council Committee Reports and Matters Initiated by City Manager, City Attorney, Staff, and Council Members.

Livermore Downtown Inc. (LDI) CM Gary said on February 24, 2015, he attended the Board Installation Dinner and Awards Ceremony.

Employee Service Awards CM Gary said he attended the event on February 24, 2015.

California Downtown Statewide Association CM Gary said he attended the annual convention that was held in Livermore.

Livermore-Pleasanton Fire Department Joint Powers Authority (LPFD-JPA) CM Gary said on March 9, 2015, he attended the meeting with Mayor Marchand.

CM Gary requested and received consensus from the Council for an informational memo on the Citys regulatory ability with regards to auto exhaust noise in the downtown.

Employee Service Awards CM Woerner said on February 24, 2015, he attended the event.

Livermore Downtown Inc. (LDI) CM Woerner said February 24, 2015, he attended the Board Installation Dinner and Awards Ceremony.

Wheels Board CM Woerner said he attended the meeting. He said the comprehensive operations analysis had been completed and the Board was interested in Livermores input.

Livermore Amador Valley Transportation Authority (LAVTA) CM Woerner said he attended the special meeting closed session.

Employee Service Awards VM Turner said on February 24, 2015, she attended the event.

Wheels Board VM Turner said on February 24, 2015, she attended the Finance Committee meeting.

Livermore Downtown Inc. (LDI) VM Turner said on February 24, 2015, she attended the Board Installation Dinner and Awards Ceremony.

Tri-Valley City Councils Meeting VM Turner said on February 25, 2015, she attended the meeting. There was discussion regarding the state legislative platform.

League of California Cities (LOCC) VM Turner said on February 26, 2015, she attended the East Bay Division meeting on taxation.

Livermore Downtown Inc. (LDI) VM Turner said on March 2, 2015, she attended the Foot Golf fundraising event for the 4th of July fireworks.

Employee Service Awards Mayor Marchand said on February 24, 2015, he attended the event.

Livermore Downtown Inc. (LDI) Mayor Marchand said on February 24, 2015, he attended the Board Installation Dinner and Awards Ceremony.

Science Odyssey Mayor Marchand said on February 25, 2015, he was a judge at the Science Odyssey.

Tri-Valley City Councils Meeting Mayor Marchand said on February 25, 2015, he attended the meeting. There was discussion regarding the state legislative platform.

California Main Street Alliance Mayor Marchand said on February 26, 2015, he attended the event.

Local Agency Formation Commission (LAFCo) Mayor Marchand said on February 27, 2015, he attended the Policy and Procedure subcommittee meeting and discussed updating by-laws.

Cayetano Park Mayor Marchand said on February 28, 2015, he attended the ribbon cutting ceremony.

Livermore Amador Valley Water Management Authority (LAVWMA) Mayor Marchand said on March 2, 2015, he attended the meeting. There was a discussion on the operations report in addition to a closed session.

Livermore Cultural Arts Commission (LCAC) Mayor Marchand said on March 4, 2015, he attended the meeting. There was a discussion on scheduling and coordinating the calendars for all of the local arts organizations.

Sandia Lab Mayor Marchand said on March 5, 2015, he attended the community outreach program.

Rotary International Mayor Marchand said on March 7, 2015, he met with the Rotary International students and they toured the police department.

Alameda County Transportation Commission (ACTC) Mayor Marchand said on March 9, 2015, he attended the 580 Express Committee meeting and the Policy Committee meeting. There were discussions on the Fast Track Flex System, freight and goods movement, and the Comprehensive Investment Plan.

8. ADJOURNMENT - Mayor Marchand said the March 16, 2015, City Council/Planning Commission Workshop would be rescheduled to a date to be determined. The meeting adjourned at 8:25 pm to a regular City Council meeting on Monday, March 23, 2015 at 7:00 pm, Council Chambers, 3575 Pacific Avenue, Livermore.
