REGULAR MEETING

CALL TO ORDER / PLEDGE OF ALLEGIANCE - The meeting of the City Council was called to order by Mayor John Marchand at 7:01 pm, in the City Council Chambers, 3575 Pacific Avenue, Livermore, California.

1.01 ROLL CALL - Present: Mayor John Marchand, Vice Mayor Bob Woerner and Council Members Robert W. Carling, Bob Coomber, and Steven Spedowfski.

PROCLAMATIONS AND PRESENTATIONS - None

CITIZENS FORUM

Dr. Roger Logan, Livermore, spoke regarding the Springtown pond and protection of the animals, especially the ducks and turtles.

Joshua Deto, Livermore, spoke regarding the Springtown pond and in opposition to a skate park.

David McGuigan, Livermore, continued his negative remarks about the police department and the Mayor.

Greg Scott, Livermore, spoke regarding the homeless in Livermore and the New Story Charity.

Larry Berger, Livermore, spoke regarding a proposal to close Trevarno Road at the pillars by Livermore Area Parks and Recreation District.

Tim Barry, General Manager, Livermore Area Parks and Recreation Department, spoke regarding calls and emails received concerning the Springtown open space and closure of the duck pond, and clarified misunderstandings about the process for the master plan.

Stella Stewart, Livermore, spoke in reference to a letter about closing Trevarno Road at the south end of the pillars.

Karl Wente, Livermore, spoke regarding clarifying term limits for Mayor Marchand and VM Woerner and keeping good government moving forward.

In response to questions by Mayor Marchand, City Attorney Jason Alcala, clarified term limits and Measure W, the change from odd year to even year elections, and that the additional year served was not counted against term limits.

John Stein, Livermore, spoke regarding the Springtown duck pond, Alameda Creek as a possible alternative for relocating the wildlife from the pond, and the negative effects of having Council Members change every two or four years.

Connie Kopps, Livermore, spoke regarding the Springtown pond, people not being heard, and in opposition to the skate park.

In response to questions by Mayor Marchand, Public Works Director Darren Greenwood clarified the robust outreach process regarding the Springtown plan and clarified the misinformation on social media, reviewed the status, the lack of water sources, poor health of birds, and the sanctuaries found for the wildlife.

CONSENT CALENDAR

ON THE MOTION OF CM CARLING, SECONDED BY CM COOMBER, AND CARRIED ON A 5-0 VOTE, THE CITY COUNCIL APPROVED THE CONSENT CALENDAR.

4.01 Ordinance introduced amending Livermore Municipal Code Chapter 2.68, Contracts and Purchasing, to implement the California Uniform Public Construction Cost Accounting Act procurement procedures and correct inconsistencies in the existing ordinance pertaining to contract signing authority for department heads; and adoption of Resolution 2018-042 electing to become subject to the Uniform Construction Cost Accounting Act procedures for public works projects in accordance with Public Contract Code Section 22010 et. Seq .

4.02 Resolution 2018-043 authorizing execution of a lease agreement with SAAB13, LLC for a restaurant at the Livermore Municipal Airport.

4.03 Resolution 2018-044 authorizing the concurrent review of General Plan Amendment 18-002 with Zoning Map Amendment 18-002 and Planned Development-Residential 18-004 for future development of affordable housing on a portion of the Civic Center parcel. Location: Pacific Avenue.

4.04 Resolution 2018-045 declaring non-complying parcels a public nuisance requiring abatement, directing staff to proceed with the 2018 Fire Hazard Abatement Program, and setting a public hearing date of April 23, 2018 to receive protests.

5.

PUBLIC HEARINGS

5.01 Hearing to review proposals for Police tow franchises submitted under the provisions of Livermore Municipal Code Chapter 5.44.

Recommendation: Staff recommended the City Council review proposals for tow franchises submitted under the provisions of Livermore Municipal Code Chapter 5.44, and adopt a resolution awarding non-exclusive franchises for City towing service to Advance Auto, Allen's Automotive and Towing Inc., Central Towing and Transport, R. Lance Tow, and Save Tow; and authorizing the City Manager to execute a Non-Exclusive Franchise Agreement for Tow Services on behalf of the City of Livermore with the approved tow companies.

Lieutenant Jason Boberg presented the staff report.

Mayor Marchand opened the public hearing.

Connie Kopps, Livermore, spoke regarding inviting competition, public works project costs available on the City's website and the cost of a concrete duck pond.

There were no more speakers and the hearing was closed.

ON THE MOTION OF CM SPEDOWFSKI, SECONDED BY VM WOERNER, AND CARRIED ON A 5-0 VOTE, THE CITY COUNCIL APPROVED AS AMENDED TO REMOVE ADVANCE AUTO FROM THE NON-EXCLUSIVE FRANCHISE AGREEMENT FOR TOW SERVICES AND ADOPTED THE FOLLOWING RESOLUTION:

Resolution 2018-046 granting non-exclusive tow franchises.

MATTERS FOR CONSIDERATION

6.01 Discussion and direction regarding recision of Resolution 2002-255, Employee Compensation Policy, and adoption of a resolution for the 2018 City Compensation Policy.

Recommendation: Staff recommended the City Council rescind Resolution 2002-255, Employee Compensation Policy, and adopt a resolution for the 2018 City Compensation Policy.

Administrative Services Director Douglas Alessio presented the staff report.

In response to questions by CM Carling, Mr. Alessio stated the City does not have a retention problem and that turnover is related to the aging workforce and retirements.

CM Coomber requested that a review of the policy should be on a five-year cycle. Mr. Alessio stated that the policy calls for a review every five to seven years.

VM Woerner asked about percentage comparisons with other cities and requested the information be available in the future.

ON THE MOTION OF CM SPEDOWFSKI, SECONDED BY CM CARLING, AND CARRIED ON A 5-0 VOTE, THE CITY COUNCIL ADOPTED THE FOLLOWING RESOLUTION:

Resolution 2018-047 rescinding Resolution 2002-255 Employee Compensation policy and adopting the City Compensation policy.

COUNCIL COMITTEE REPORTS AND MATTERS INIATED BY CITY MANAGER, CITY ATTORNEY, STAFF, AND COUNCIL MEMBERS

7.01 Council Committee Reports and Matters Initiated by City Manager, City Attorney, Staff, and Council Members.

Livermore-Amador Valley Transit Authority (LAVTA) - CM Coomber attended the meeting on April 2, 2018.

Employee Service Awards Luncheon- CM Carling attended the ceremony on February 27, 2018.

StopWaste - CM Carling attended the March meetings.

Bay Association of Realtors - CM Carling attended the meeting on behalf of Mayor Marchand where housing information in the state was provided.

Police Department Swearing In Ceremony - CM Carling attended the ceremony on March 15, 2018.

Youth in Government Day - CM Carling participated in the program on March 21, 2018 on behalf of Mayor Marchand.

East Bay Innovation Awards - CM Carling attended the ceremony on March 29, 2018.

Livermore-Amador Valley Transit Authority (LAVTA) - CM Spedowfski attended the meeting where new bus designs were decided.

East Bay Community Choice Energy Joint Powers Authority (EBCEJPA) - CM Spedowfski attended the meeting where information was presented regarding switching from PG&E to East Bay Community Energy.

Tri-Valley San Joaquin Valley Regional Rail Authority - CM Spedowfski attended the meetings where station options and costs were discussed.

Altamont Open Space Committee - VM Woerner attended the meeting where it was decided to write a letter supporting Senator Glazer's legislation allowing Tesla Park to be bought.

VM Woerner requested staff follow through with a letter as requested by Nancy Rodrigue at the March 26, 2018 Council meeting regarding supporting Senate Bill 1316, for the permanent preservation of Tesla Park.

VM Woerner requested staff document the feasibility of a cement duck pond and what it would cost.

VM Woerner requested staff provide a memo to Council and follow up with residents on an analysis of a gate at the east side of Trevarno Road.

Water Liaison Committee - Mayor Marchand attended the meeting on March 1, 2018.

BART Board Meeting - Mayor Marchand attended the meeting on March 8, 2018 where he spoke about full BART to Livermore.

Local Area Formation Commission (LAFCO) - Mayor Marchand attended the meeting on March 8, 2018.

Alameda County Transportation Commission (ACTC) - Mayor Marchand attended the meeting on March 12, 2018 where the Senate Bill 1 repeal effort was discussed, and said Regional Measure 3 will be on the ballot raising bridge tolls.

Livermore and Granada High School Program - Mayor Marchand and Chief Harris attended the program where campus mass shootings and student safety were discussed.

Altamont San Joaquin Regional Rail Authority - Mayor Marchand attended the meeting on March 14, 2018.

Alameda County Mayors Conference - Mayor Marchand attended the meeting on March 14, 2018 where a presentation on earthquake simulation was made by the United States Geological Survey.

Bay East 2018 Real Estate Summit - Mayor Marchand attended the meeting on March 15, 2018.

Police Department Swearing In Ceremony - Mayor Marchand attended the ceremony on March 15, 2018.

Poet Laureate Science and Poetry Program - Mayor Marchand attended the program at the library.

East Bay Economic Development Alliance - Mayor Marchand attended the meeting on March 20, 2018 where there was an update on Senate Bill 1 and Regional Measure 3, and a recap of the legislative day in Sacramento.

Tri-Valley Mayors Delegation - Mayor Marchand attended the meeting on March 21, 2018 where there was extensive discussion regarding Senate Bill 827.

Alameda County Transportation Commission (ACTC) - Mayor Marchand attended the meeting on March 22, 2018 where there was extensive debate regarding redirecting Measure B funds.

Lawrence Lab Foundation - Mayor Marchand attended the meeting on March 22, 2018.

Hindu Community and Cultural Center - Mayor Marchand attended the annual grant and aid program on March 24, 2018 where funds were given to help non-profits.

Bay Area Counsel Symposium - Mayor Marchand attended the meeting at University of the Pacific on April 3, 2018 where transit was discussed.

Alameda County Transportation Commission (ACTC) - Mayor Marchand attended the meeting on April 9, 2018 where an update was given on the I-580 transit lane usage.

Springtown Pond - Mayor Marchand visited the Springtown pond on April 9, 2018, providing information to residents in response to recent social media, answering questions and clarifying the facts surrounding the project.

Mayor Marchand requested staff provide information on how to best engage the state, counties and other elected officials to free up the $2.5 billion of state funds for mental health that have been allocated at the county and local levels, and the $2 billion in state funds allocated for homelessness.

ADJOURNMENT - 8:29 pm Mayor Marchand adjourned the regular City Council meeting in memory of Gary Drummond, Livermore's first Town Historian, to a regular City Council meeting on Monday, May 14, 2018 at 7:00 pm, Council Chambers, 3575 Pacific Avenue, Livermore.
