REGULAR MEETING

CALL TO ORDER / PLEDGE OF ALLEGIANCE - The meeting of the City Council was called to order by Vice Mayor Spedowfski at 7:00 pm, in the City Council Chambers, 3575 Pacific Avenue, Livermore, California.

1.01 ROLL CALL - Present: Vice Mayor Steven Spedowfski, and Council Members Robert W. Carling, Bob Coomber, and Bob Woerner. Mayor John Marchand was absent/excused.

PROCLAMATIONS AND PRESENTATIONS

2.01 Community Asset Management Program Committee (CAMP) update

CAMP Chairperson Susan Frost presented the update.

2.02 Confirmation of appointment and administration of oath of office

Poet Laureate

Cynthia Patton for a two-year term ending June 30, 2019.

Connie Post, Livermore, spoke regarding being the City's founding Poet Laureate.

Kevin Gunn, Livermore, spoke regarding his experience as poet laureate and recited a poem.

ON THE MOTION OF CM CARLING, SECONDED BY CM WOERNER, AND CARRIED ON A 4-0 VOTE, THE CITY COUNCIL CONFIRMED THE APPOINTMENT.

Deputy City Clerk Jean Bell administered the oath of office to the newly appointed Poet Laureate.

Cynthia Patton, Poet Laureate recited her poem, "A Place to Call Home".

CITIZENS FORUM

Andrew Barker, Livermore spoke regarding recent action taken by the City related to a former police officer.

Saro Zargarian, Livermore spoke regarding construction noise by Central Avenue, noise ordinance hours and Central Avenue speeders in the area of Montessori and Croce schools.

Elizabeth Judge, Livermore spoke regarding a proposed trolley concept for the downtown.

David McGuigan, Livermore continued to make remarks about the Police Department regarding the events of his arrest.

Jeff Kaskey, Livermore spoke regarding an additional meeting of the Downtown Steering Committee, the 2014 parking study, and the train depot.

Alaina Habiger, 4-H spoke about her lambs for auction at the Alameda County Fair.

John Stein, Livermore spoke regarding the City's replacing a row of trees on Fourth Street at Carnegie, a new location for the Farmer's Market, and restoration versus reconstruction of the train depot.

CONSENT CALENDAR

Item 4.02 Brent Siler, Livermore spoke about taxes and increased water rates.

Item 4.05 Heather Greaux, Executive Director Open Heart Kitchen spoke in support of the project.

Item 4.05 Darin Lounds, Executive Director Housing Consortium of the East Bay spoke in support of the project.

ON THE MOTION OF CM WOERNER, SECONDED BY CM CARLING, AND CARRIED ON A 4-0 VOTE, THE CITY COUNCIL APPROVED THE CONSENT CALENDAR.

4.01 Adoption of Ordinance 2055 amending section 4.06.040, Prohibited Signs, to allow electronic reader board signs at private K-12 schools. Development Code Amendment 17-001.

4.02 Resolution 2017-085 authorizing execution of professional services agreements with SNG & Associates, Resolution 2017-086 with Gil's Consulting, and Resolution 2017-087 with Daniel B. Valiao, to provide on-call plan check review and development engineering review services.

4.03 Resolution 2017-088 authorizing the execution of an agreement with Schaaf & Wheeler in the amount of $458,181 for engineering services for the 2017 Storm Damage Repairs Project No. 2017-25.

4.04 Resolution 2017-089 authorizing the execution of an agreement with Allana Buick and Bers, Inc. in the amount of $188,100 for engineering services for the Recoating of Building Exterior Insulation Finishing System Project No. 2015-16.

4.05 Resolution 2017-090 appropriating City Affordable Housing Trust Funds in an amount not to exceed $355,970 to Tri Valley BMR, LLC for predevelopment and acquisition feasibility analysis for the property located at 460 N. Livermore Avenue; authorizing execution of a loan agreement in the amount of $355,970 and all related documents. The vision for the site is to expand existing food and support services for the homeless and create housing units that would support the City's Housing First initiative to move people out of homelessness in Livermore.

4.06 Resolution 2017-091 authorizing continued participation in the Alameda County Home Investment Partnership Program (HOME) Consortium for HOME Investment Partnership funds, and execution of an agreement with Alameda County Housing and Community Development to receive HOME funding for Fiscal Years 2017-20.

4.07 Resolution 2017-092 to adopt the Memorandum of Understanding with the Livermore Police Management Association and Resolution 2017-093 to amend the City of Livermore Salary Plan.

4.08 Resolution 2017-094 authorizing international travel and supplemental budget appropriation in the amount of $1,500 to participate in the 2017 Livermore-Yotsukaido Sister City Organization Exchange Trip Program.

4.09 Resolution 2017-095 authorizing the execution of a purchase order with Baker & Taylor Books in an amount not to exceed $200,000 for the purchase of books and audiovisual materials for Fiscal Year 2017-18.

4.10 Resolution 2017-096 accepting State of California Alcohol Beverage Control grant funds in the amount of $14,705 to further the City's commitment to education and enforcement efforts related to the responsible sale and consumption of alcoholic beverages.

4.11 Resolution 2017-097 authorizing the filing of an application for One Bay Area Grant Cycle 2 (OBAG2) funding assigned to Metropolitan Transportation Commission, committing necessary matching funds, and stating assurance to complete the 2018 Arterial Street Rehabilitation Project. (Project No. 2018-46)

5.

PUBLIC HEARINGS

5.01 Hearing to consider the five-year adjustments to City of Livermore water rates and meter service charges. This adjustment does not affect California Water Service customers.

Recommendation: Staff recommended the City Council determine that a majority protest to adjusting the City of Livermore water rates and meter service charges does not exist; adopt a resolution to annually increase water rates and meter service charges effective August 1, 2017 and July 1st of each subsequent year through 2021, and authorize a pass-through of wholesale water costs for the next five years.

Public Works Director Darren Greenwood and consultant Habib Isaac, Raftelis, presented the staff report.

In response to questions by CM Carling and VM Spedowfski, Mr. Greenwood and Mr. Isaac provided clarification.

Vice Mayor Spedowfski opened the public hearing.

Anthony Godrich, Livermore spoke regarding increase percentages and against the increase.

Elizabeth Judge, Livermore spoke regarding conserving water and reviewing the tier structure of the water rate increases.

Bruce Shore, Livermore spoke in favor of fiscal responsibility and a review of the objections stated by the previous speakers.

Todd Walberg, Livermore spoke against the current rate increase.

There were no more speakers and the hearing was closed.

In response to a request for clarification by CM Woerner and CM Carling regarding confusion on the increase of revenue over time, Public Works Director Darren Greenwood and consultant Mr. Isaac, Raftelis, clarified the individual tier rate amounts and the overall bill.

ON THE MOTION OF CM CARLING, SECONDED BY CM WOERNER AND CARRIED ON A 4-0 VOTE, THE CITY COUNCIL ADOPTED THE FOLLOWING RESOLUTION:

Resolution 2017-098 amending water rates and charges for fiscal years 2017-18 through 2021-22.

MATTERS FOR CONSIDERATION

6.01 Discussion and direction regarding revisions to Livermore Municipal Code, Chapter 2.14, Elections.

Recommendation: Staff recommended the City Council receive the report and provide direction to staff for potential revisions to Livermore Municipal Code, Chapter 2.14, Elections.

Item 6.01 was rescheduled to July 10, 2017 City Council Meeting.

7.

COUNCIL COMMITTEE REPORTS AND MATTERS INITIATED BY THE CITY MANAGER, CITY ATTORNEY, STAFF, AND COUNCIL MEMBERS

7.01 Council Committee Reports and Matters Initiated by City Manager, City Attorney, Staff, and Council Members.

Citizens Police Academy CM Carling said on May 31, 2017 he attended the Citizens Police Academy graduation and the Tri-Valley Council meeting and dinner.

Gillig CM Carling said on June 1, 2017 he attended the ribbon cutting.

Eagle Court of Honor CM Carling said on June 3, 2017 he attended the Boy Scout ceremony.

Chamber of Commerce CM Carling said on June 21, 2017 he attended the Chamber luncheon where the Mayor gave the State of the City address.

BevMo CM Carling said on June 22, 2017 he and CM Coomber attended the reopening at BevMo's new location at the old Applebee's site.

Relay for Life CM Carling said on June 24, 2017 he and CM Coomber attended the relay at Livermore High School, which is now a joint event between Livermore, Pleasanton and Dublin.

Relay for Life CM Coomber stated that he would like to see the City create a team for next year's relay.

Paratransit Advisory and Planning Committee CM Coomber attended the meeting on June 27, 2017 where programs and projects were approved. A Mobility Forward meeting presented by Livermore-Amador Valley Transit Authority will take place at the Robert Livermore Community Center June 27, 2017 from 10:00 am to noon to review needs of paratransit in the Tri-valley area.

Downtown Steering Committee CM Woerner said they are making good progress and will be returning to Council on July 31, 2017 with an update.

San Joaquin Alameda Regional Rail Working Group VM Spedowfski said he attended the meeting on June 14, 2017 where there was discussion regarding BART's consideration of attaching a full-service yard to the EIR for the additional five miles of railway. The Working Group is hoping to pass legislation and take control.

Downtown Finance Committee VM Spedowfski said he attended the meeting.

Veteran of the Year Ceremony VM Spedowfski said on June 22, 2017 he attended the ceremony hosted by Assemblywoman Catherine Baker where Livermore resident, LLNL engineer and former Marine Destiny Goddu was named Veteran of the Year.

Livermore-Amador Valley Transit Authority VM Spedowfski said June 26, 2017 the Projects and Services Committee reviewed the free ride program. Next year through a grant, clipper cards will be available to students at Christensen, Livermore High, Del Valle and East Avenue schools to ride the bus free of charge.
