REGULAR MEETING

1. CALL TO ORDER/PLEDGE OF ALLEGIANCE The meeting of the City Council was called to order by Mayor John Marchand at 7:06 pm, in the City Council Chambers, 3575 Pacific Avenue, Livermore, California.

1.01 ROLL CALL Present: Mayor John Marchand, Vice Mayor Bob Woerner, and Councilmembers Stewart Gary, Doug Horner, and Laureen Turner.

2. PROCLAMATIONS AND PRESENTATIONS

2.01 Proclamation declaring October 24, 2014, as World End Polio Day.

Mayor Marchand presented a proclamation to Livermore Rotarians Milly Seibel and Charles Crohare declaring October 24, 2014 as World End Polio Day.

3. CITIZENS FORUM

Connie Kopps, Livermore, presented a fund raising project to help support Livermore Downtown Inc.

Judy Galletti, Livermore, spoke in opposition to Measure BB.

Don Meeker, Livermore, presented a brief historical review of George Tubbs and the first low-income housing in Livermore.

John Stein, Livermore, spoke regarding the drought, the Arroyo Mocho channel, and the effect of retirement on executive management of the City.

4. CONSENT CALENDAR

Mayor Marchand removed Item 4.04 from the Consent Calendar for separate discussion and action.

ON THE MOTION OF CM HORNER, SECONDED BY CM TURNER, AND CARRIED ON A 5-0 VOTE, THE CITY COUNCIL APPROVED CONSENT CALENDAR ITEMS 4.01 THROUGH 4.03.

4.01 Approval of Minutes September 8, 2014 regular City Council meeting and September 22, 2014 regular City Council meeting.

4.02 Resolution 2014-164 accepting for permanent maintenance and releasing of security for the Isabel Avenue Public Sanitary Sewer Main. (Shea Center Livermore, LLC and Shea Homes at Montage, Inc.)

4.03 Resolution 2014-165 authorizing the release of a request for proposal for a non-profit organization to provide services that are agricultural or farming in nature and/or provide education regarding the history of the property. Location: Hagemann Farm, 455 Olivina Avenue.

4.04 Urging Congress to re-purpose the Veterans Affairs Palo Alto Health Care System (VAPAHCS) Livermore Division facility.

Mayor Marchand said he had been working with local elected officials to re-purpose the Veterans Affairs Palo Alto Health Care System Livermore Division facility, commonly known as the Livermore Veterans Administration Hospital (VA Hospital). He recounted his meeting at the White House with First Lady Michelle Obama where he presented the first draft of this resolution to re-purpose the facility to a Post-Traumatic Stress Disorder treatment center and to provide transitional housing for returning or homeless veterans.

Mayor Marchand invited public comment on Item 4.04.

Pattiy Ising, Livermore, spoke regarding the benefits of keeping the VA Hospital open in Livermore and supported adoption the resolution.

Michelle Mitchell, Livermore, spoke regarding the benefits of keeping the VA Hospital open in Livermore and supported adoption the resolution.

Bud Donaldson, Livermore, spoke regarding the benefits of keeping the VA Hospital open in Livermore and supported adoption the resolution.

Pat Wheeler, Livermore, spoke regarding the benefits of keeping the VA Hospital open in Livermore and supported adoption the resolution.

Sharon Myers, Livermore, spoke regarding the benefits of keeping the VA Hospital open in Livermore and supported adoption the resolution.

Don Meeker, Livermore, supported adoption of the resolution.

Raymond LaRochelle, Livermore, spoke regarding the benefits of keeping the VA Hospital open in Livermore and supported adoption the resolution.

Alicia Thorpe, Livermore, spoke regarding the benefits of keeping the VA Hospital open in Livermore and supported adoption the resolution.

Tami Jenkins, Livermore, spoke regarding the benefits of keeping the VA Hospital open in Livermore and supported adoption the resolution.

ON THE MOTION OF MAYOR MARCHAND, SECONDED BY VM WOERNER, AND CARRIED ON A 5-0 VOTE, THE CITY COUNCIL APPROVED ITEM 4.04 AND ADOPTED THE FOLLOWING RESOLUTION: Resolution 2014-166 urging Congress to re-purpose the Veterans Affairs Palo Alto Health Care System (VAPAHCS) Livermore Division facility.

5. PUBLIC HEARINGS None.

6. MATTERS FOR CONSIDERATION

6.01 Discussion and direction regarding City Council appointments to Intergovernmental Agencies. None.

6.02 Discussion and direction regarding the Fourth of July fireworks celebration in the Downtown.

Recommendation: Staff recommended the City Council accept the 2014 event summary and provide direction for future events.

Permit Center Manager David Rashè presented the staff report.

Mayor Marchand invited public comment.

Rachael Snedecor, Livermore Downtown Inc. (LDI), spoke regarding the positive working relationship with the Veterans Association in the promotion of the 4th of July event. She said LDI looked forward to promoting the 4th of July event again in the future. She said the fireworks could be seen from many locations city-wide.

ON THE MOTION OF CM GARY, SECONDED BY VM WOERNER, AND CARRIED ON A 5-0 VOTE, THE CITY COUNCIL DIRECTED STAFF TO PROCEED WITH COORDINATING WITH LIVERMORE DOWNTOWN INC. TO PLAN THE 2015 EVENT; AUTHORIZED MAXIUMUM FUNDING IN THE AMOUNT OF $25,000; EXPLORE FUNDRAISING EFFORTS TO INCLUDE CORPORATE SPONSORSHIPS; AND AUTHORIZED IN-KIND STAFFING TO SUPPORT THE EVENT.

6.03 Resolution authorizing execution of an agreement with Livermore Downtown Inc., in the amount of $75,000, for Fiscal Year 2014-2015 operating expenses.

Recommendation: Staff recommended the City Council adopt the resolution.

Assistant Community and Economic Development Director Eric Uranga presented the staff report.

Rachael Snedecor, Executive Director, Livermore Downtown Inc., (LDI) presented the 2013-2014 Annual Report.

The City Council expressed their appreciation for the positive efforts LDIs activities have contributed to the economic health and vitality of the City. The Council expressed the desire to contribute the partnership.

CM Gary suggested a formation of an ad-hoc committee comprised of representatives from LDI, a sub-committee of the City Council, and City staff to establish a strategic business relationship to define roles and responsibilities. He said in-lieu of the annual grant request, staff should explore making this a two-year budget commitment or a five-year business plan.

VM Woerner said he supported establishing a long-term commitment with LDI for the future development of the Downtown.

ON THE MOTION OF CM GARY, SECONDED BY CM WOERNER AND CARRIED ON A 5-0 VOTE, THE CITY COUNCIL ADOPTED THE FOLLOWING RESOLUTION:

Resolution 2014-167 authorizing execution of an agreement with Livermore Downtown Inc., in the amount of $75,000, for Fiscal Year 2014-2015 operating expenses.

6.04 Discussion and direction regarding pending State or Federal legislation. None.

7. COUNCIL COMMITTEE REPORTS AND MATTERS INITIATED BY CITY MANAGER, CITY ATTORNEY, STAFF AND COUNCILMEMBERS

7.01 Council Committee Reports and Matters Initiated by City Manager, City Attorney, Staff, and Councilmembers.

CM Horner did not have a report.

Livermore-Amador Valley Transportation Authority (LAVTA) CM Turner said she attended the meeting on October 6, 2014. She said work continued on the performance of para-transit and development of a strategic plan with the tri-valley cities; and said Michael Tree had been hired as the new executive director.

Altamont Landfill Community Monitor Committee CM Turner said on October 8, 2014, she attended the meeting.

Livermore-Pleasanton Fire Department Joint Powers Authority (LPFD JPA) CM Gary said he attended the Closed Session of the LPFD JPA on October 13, 2014.

Downtown CM Gary requested staff follow-up on trash left behind closed businesses in the downtown and temporary lighting in the unpaved downtown parking area.

Livermore-Amador Valley Transportation Authority (LAVTA) VM Woerner said he attended the meeting on October 6, 2014. He said the new executive director had experience with implementing a new direction for a bus company that provided quicker and more direct routes.

VM Woerner expressed his appreciation for the improvements at the Murrieta and Stanley Boulevard intersection.

Alameda County Transportation Council (ACTC) Mayor Marchand said he attended the September 25, 2014, board meeting.

Water Agencies Liaison Committee Mayor Marchand said on September 27, 2014, he attended the meeting to discuss short and long term solutions to the drought and regional water issues.

Altamont Cruisers Mayor Marchand said he attended the 25th Nostalgia Day Car Show on September 28, 2014. He said the Mayors Award was presented to the 1938 Chevy coupe.

Mayors Town Hall Mayor Marchand said on September 29, 2014, he presented the Mayors Town Hall address that was attended by more than 60 residents.

Livermore Cultural Arts Council (LCAC) Mayor Marchand said on October 1, 2014, he attended the meeting.

Livermore Area Youth Advisory Commission Mayor Marchand said on October 6, 2014, he attended the meeting and lead a discussion on the Bully Project. He said the Youth Commission would be assisting the City, Horizons, the school district and the faith based community with this anti-bullying project.

Mayors Conference Mayor Marchand said he attended the conference on October 8, 2014, in Union City. He said there was a presentation on One Bay Area.

13th Annual ArtWalk Mayor Marchand said he attended the festival in Downtown Livermore on October 11, 2014.

Livermore-Pleasanton Fire Department Joint Powers Authority (LPFD JPA) Mayor Marchand said he attended the Closed Session of the LPFD JPA on October 13, 2014.

Alameda County Transportation Council (ACTC) Mayor Marchand said he attended the October 13, 2014, I-580 Express Lane Committee where there was a report on the High Occupancy Vehicle (HOV) lanes. He also attended the Planning Policy and Legislative Committee meeting to discuss the comprehensive investment plan and received an update on the Transportation Expenditure Plan (TEP).

ADJOURNMENT at 8:30 pm in memory of retired Alameda County Fire Chief Bill McCammon to a regular City Council meeting on Monday, October 27, 2014 at 7:00 pm, Council Chambers, 3575 Pacific Avenue, Livermore.
