REGULAR MEETING 1.

CALL TO ORDER / PLEDGE OF ALLEGIANCE - The meeting of the City Council was called to order by Mayor John Marchand at 7:01 pm, in the City Council Chambers, 3575 Pacific Avenue, Livermore, California.

1.01 ROLL CALL - Present: Mayor John Marchand, Vice Mayor Stewart Gary, and Council Members Laureen Turner and Bob Woerner. CM Spedowfski was absent/excused.

PROCLAMATIONS AND PRESENTATIONS

2.01 Confirmation of the reappointment of James N. Doggett to the Alameda County Mosquito Abatement District Board of Trustees.

ON THE MOTION OF CM TURNER, SECONDED BY VM GARY AND CARRIED ON A 4-0 VOTE, THE CITY COUNCIL CONFIRMED THE REAPPOINTMENT.

2.02 Presentation by the Alameda County Mosquito Abatement District.

The following Alameda County Mosquito Abatement District representatives presented the update: Ryan Clausnitzer, District Manager; Tom McMahon, Vector Biologist; and James N. Doggett, Board Member.

CITIZENS FORUM

Bill Pedrini, Livermore, spoke regarding moving from San Mateo and how much he and his wife liked living in Livermore.

Dave Wetmore, Livermore, representing Little League International, announced the dates for the 2017 Little League World Series Tournaments.

David McGuigan, Livermore, continued his negative commentary on the Livermore Police Department.

Michaela Toscas, Livermore, Higher Elevation Community Collective, spoke regarding zoning for a medicinal marijuana dispensary.

Adam Pine, Floral Element, spoke regarding the regulatory structure for medicinal marijuana dispensaries in Livermore.

John Stein, Livermore, thanked VM Gary and CM Turner for their years of service on the City Council. He spoke regarding auto related business in the downtown, street trees, and design elements for new construction.

Connie Kopps, Livermore, spoke regarding the purchase of the Springtown Golf Course, the official map, and the conflict of interest by those serving on the Council, LARPD Board, and TV30.

CONSENT CALENDAR

Item 4.06 Connie Kopps, Livermore, questioned the location of Community Resources for Independent Living (CRIL).

ON THE MOTION OF CM WOERNER, SECONDED BY VM GARY, AND CARRIED ON A 4-0 VOTE, THE CITY COUNCIL APPROVED THE CONSENT CALENDAR.

4.01 Approval of Minutes - October 10, 2016 regular City Council meeting; October 17, 2016 City Council special meeting closed session; and October 24, 2016 regular City Council meeting.

4.02 Adoption of Ordinance 2043 amending Municipal Code Chapter 2.68, Contracts and Purchasing, Section 2.68.430, Surplus Supplies and Equipment, to grant the Administrative Services Director authority to surplus service weapons and badges of Livermore Police Department employees.

4.03 Ordinance introduced amending Municipal Code Title 15, Building and Construction, to repeal old codes and adopt the new 2016 editions of the California Building, Electrical, Mechanical, Plumbing, Residential and Green Building Standards Codes, the 2015 edition of the International Property Maintenance Code, the 2016 California Fire Code and adopt minor administrative corrections within the Building, Fire, Residential codes that will help clarify the intent of pertinent sections. The effective date of the ordinance will be January 1, 2017.

4.04 Resolution 2016-148 accepting for permanent maintenance and releasing of security for the Safe Routes to School, Project No. 2015-29.

4.05 Resolution 2016-149 ending wastewater and storm drainage connection fee subsidies and adopting fee schedules for wastewater and storm drainage connection fees.

4.06 Resolution 2016-150 authorizing execution of lease agreements for space at the Multi-Service Center with Abode Services, Alameda County Social Services Agency, Axis Community Health, Community Association for Preschool Education, Community Resources for Independent Living, Eden Council for Hope and Opportunity, and East Bay Innovations.

4.07 Resolution 2016-151 appropriating $47,282 in additional Public, Educational, and Government access funds for Tri-Valley Community Television and authorizing execution of a contract for services for capital expenditures.

4.08 Resolution 2016-152 approving the 2016 amendment to the employment contract with the City Manager.

4.09 Resolution 2016-153 approving an amended and restated employment contract with the City Attorney.

4.10 Resolution 2016-154 approving Executive Management Group Employees wage and benefits adjustments.

5. PUBLIC HEARINGS - None.

MATTERS FOR CONSIDERATION

6.01 Discussion and direction regarding a height limit reduction for residential projects within the Downtown Specific Plan Area.

Recommendation: Staff recommended the City Council provide direction.

THE CITY COUNCIL RESCHEDULED ITEM 6.01 TO THE JANUARY 9, 2017 CITY COUNCIL MEETING.

6.02 Discussion and direction regarding Livermore's participation in the Alameda County Waste Management Authority's amended ordinance regulating the use of carryout bags and promoting the use of reusable bags (Expanded Reusable Bags Ordinance).

Recommendation: Staff recommended the City participate in the amended ordinance. No City Council action was needed to participate.

Public Works Manager Judy Erlandson presented the staff report.

Mayor Marchand invited public comment.

Connie Kopps, Livermore, spoke regarding her intellectual property rights and the other uses for reusable bags.

THE CITY COUNCIL RECEIVED THE REPORT. NO ACTION WAS TAKEN.

6.03 Discussion and direction regarding the Bicycle, Pedestrian, and Trails Active Transportation Plan draft goals and policies.

Recommendation: Staff recommended the City Council provide direction.

Associate Planner Debbie Bell, Assistant Planner Andy Ross, and Lisa Beyer of Alta Planning and Design presented the staff report, draft goals, and policies.

Mayor Marchand invited public comment. There were no speakers.

In response to questions by CM Woerner, Ms. Beyer spoke of the cooperation with the cities of Pleasanton and Dublin to improve connections, safety, and usage; and said a sampling of trends over time would be prepared for Council review. She said the opportunity to improve the transportation plan would include engaging a larger transportation community by looking at other communities across the country. Ms. Bell said the committee was actively working with other Tri-Valley cities, the Park District and the county on larger circulation patterns.

VM Gary requested the plan include links to established valley trail systems and expand and improve connections to popular locations such as Brushy Peak and other regional parks. He said the missing link connections should include Arroyo Road to Wente and the Del Valle dam complex. He suggested the bike lane on Tesla be extended to Greenville Road.

CM Turner received verification that the Iron Horse Trail would be connected to Vasco Road through the use of Measure BB funds. She said the larger use of the trails would be recreational biking.

Mayor Marchand said there should be improved access on First Street to Springtown and spoke regarding using social media to encourage more walking and biking in the community.

THE CITY COUNCIL ACCEPTED THE UPDATE AND DIRECTED STAFF TO INCLUDE THE ORAL COMMENTS BY THE COUNCIL IN PLANNING EFFORTS.

COUNCIL COMMITTEE REPORTS AND MATTERS INITIATED BY CITY MANAGER, CITY ATTORNEY, STAFF AND COUNCIL MEMBERS

7.01 Council Committee Reports and Matters Initiated by City Manager, City Attorney, Staff, and Council Members.

CM Turner did not have a report.

CM Woerner did not have a report.

VM Gary did not have a report.

Mayor's Summit Mayor Marchand said on October 26, 2016 he attended the summit. He said the summit was moderated by Assembly Member Catharine Baker and all five Tri-Valley mayors were in attendance. The focus of the summit was regional collaboration.

Alameda County Transportation Commission (ACTC) Mayor Marchand said on October 27, 2016 he attended the board meeting.

U.S. Conference of Mayors Mayor Marchand said he attended the November 2-3, 2016 Mayor's Water Council meeting. There was discussion on private-public partnerships.

Library Dedication Mayor Marchand said on November 3, 2016 he attended the Little Free Library dedication ceremony. He said the library was built by Cadettes from Livermore Girl Scout Troop 30310. He said the library would serve all members of the community, especially the lower income housing community of the Ironwood Apartment complex on Charlotte Way and East Avenue who might not have access to or the means to acquire literature.

Local Agency Formation Commission (LAFCo) Mayor Marchand said on November 7, 2016 he attended the special meeting to gain public input on the Eden Township Healthcare District.

Altamont Regional Rail Mayor Marchand said on November 9, 2016 he attended the meeting to review the updated transit oriented development plans for the Isabel Station area and BART to ACE.

Alameda County Mayors Conference Mayor Marchand said there was a presentation by LAFCo.

East Bay Economic Development Alliance (EBEDA) Mayor Marchand said on November 10, 2016 he attended the workshop on international trade.

Alameda County Transportation Commission (ACTC) Mayor Marchand said on November 14, 2016 he attended the meeting where there was an update on the I-580 Express Lanes. He said there were over 31,000 trips per day; 4.6 million trips since January 2016; and 57% of the cars were paying tolls for total revenue of $5 million with $2 million revenue over expenses.

Proposition 64 City Attorney Jason Alcala requested direction from the City Council regarding preparation of a staff report for consideration of local control and regulation for the adult use of marijuana.

VM Gary received consensus from the City Council for the currently seated Council to move forward with receiving the staff report regarding the regulation of medicinal cannabis dispensaries at the December 12, 2016 City Council meeting; consideration regarding the establishment of local control and regulation for the adult use of recreational marijuana would be presented to the newly elected City Council at a future meeting.
