CALL TO ORDER / PLEDGE OF ALLEGIANCE - The meeting of the City Council was called to order by Mayor John Marchand at 7:01 pm, in the City Council Chambers, 3575 Pacific Avenue, Livermore, California.

1.01 ROLL CALL - Present: Mayor John Marchand, Council Members Robert W. Carling, Bob Coomber, and Bob Woerner. Vice Mayor Steven Spedowfski was absent/excused.

CITIZENS FORUM

Robert S. Allen, Livermore, provided comments on the BART draft environmental impact report and options for connecting ACE and BART.

David McGuigan, Livermore, continued speaking about the Livermore Police and the Mayor.

Mark Triska, Livermore, spoke regarding the community respecting opinions and working together on the Downtown.

Doug Mann, Livermore, spoke regarding the Council's commitment to the City and considering feedback from the community as a whole.

Greg Scott, Livermore, spoke regarding the police department and the homeless.

Nancy Bankhead, Livermore, spoke regarding the cost of the signage over Fourth Street and North Livermore Avenue.

CONSENT CALENDAR

Item 4.03 was removed from the Consent Calendar for separate action.

ON THE MOTION OF CM CARLING, SECONDED BY CM COOMBER, AND CARRIED ON A 4-0 VOTE, THE CITY COUNCIL APPROVED ITEMS 4.01, 4.02, 4.04 AND 4.05 ON THE CONSENT CALENDAR.

4.01 Approval of Minutes - November 13, 2017 regular City Council meeting.

4.02 Adoption of an ordinance 2064 establishing the South Livermore Valley - Agriculture Zoning Standards for the Concannon Winery.

4.04 Resolution 2017-187 authorizing execution of a Memorandum of Understanding between the Livermore Police Department and the California Highway Patrol to assist in providing police services on state owned property.

4.05 Resolution 2017-188 approving the list of projects funded by Senate Bill 1 (the Road Repair Accountability Act) and approving Road Maintenance and Rehabilitation Account funds for the 2018 Street Resurfacing Project No. 2018-01 in the amount of $300,000 and the 2018 Slurry Seal Project No. 2018-04 in the amount of $200,000.

4.03 Introduction of an ordinance adopting modifications to the Livermore Municipal Code to update references; strike outdated terms; add additional references; clarify existing provisions; and to make additional technical or nonsubstantive corrections.

Mayor Marchand invited public comment.

Item 4.03 Brent, requested the omnibus ordinance include amendment to section 6.12.140 Dog Leash Requirements, to exclude first responder canines from the six-foot leash requirement.

THE CITY COUNCIL DIRECTED THE ORDINANCE BE REINTRODUCED AT THE DECEMBER 11, 2017 MEETING TO INCLUDE LANGUAGE EXCLUDING FIRST RESPONDER CANINES FROM THE SIX-FOOT LEASH REQUIREMENT.

5. PUBLIC HEARINGS - None.

MATTERS FOR CONSIDERATION

6.01 Discussion and direction regarding the Downtown Public Engagement Report and Next Steps.

Recommendation: Staff recommends the City Council:

a) Accept the Downtown Public Engagement Final Report and provide direction regarding the development and evaluation of conceptual plans for the City's downtown catalyst sites;

b) Discuss and provide direction regarding the Livermore Stockmen's Rodeo Association proposal; and

c) Discuss and provide direction regarding staff's contact with downtown property and business owners along First Street regarding potential acquisition of City property.

David Early, PlaceWorks, Consultant, presented the Downtown Public Engagement Report.

Planning Manager Steve Stewart said staff followed Council direction to meet with the Livermore Stockmen's Rodeo Association regarding amending the existing agreement limiting development of the property on Pacific Avenue. He presented an overview.

Mayor Marchand invited public comment.

Carla Zaragoza, spoke regarding a need for a science learning facility in the Downtown.

Palak Guleria, spoke regarding a science learning center in the Downtown.

David Kent, Livermore, spoke in favor of the principals of the Unified Concept vision; build for the future, repay the debt and for Council to decide on the location of the hotel.

Darcie Kent, Livermore, described more of the Unified Concept vision.

Lisa Tromovich, Artistic Director, Livermore Shakespeare Festival, spoke regarding the vision of the Unified Concept.

Dave Finster, President, Livermore Stockmen's Rodeo Association, spoke in support of the Unified Concept.

Evan Branning, Livermore, said affordable housing was a priority and asked if the statistics for the different priorities were weighted to better represent the demographics of Livermore.

In response to Mayor Marchand, David Early, PlaceWorks, said the results were not weighted in any way.

Dale Kaye, CEO Innovation Tri-Valley Leadership Group, spoke in support of the elements of the Unified Concept and that housing was essential.

Asa Strout, Livermore, read a letter in support of affordable workforce housing, and vibrant and diverse retail in the Downtown.

Sherry Nigg, Livermore, spoke in support of the Unified Concept.

Victoria Fierce, CaRLA, spoke regarding affordable housing funds and proposed non-housing uses on Railroad Avenue.

Steven Dunbar, Hayward, spoke regarding the need for housing in the Downtown.

Brendan Adams, Livermore, spoke in support of the Unified Concept and more housing in the Downtown.

Mary Burnham, Livermore, read a letter from Steve Azivido in support of a science center in the Downtown.

Allan Burnham, Livermore, spoke in support of the Unified Concept and a science center in the Downtown.

Alyissa Perry, Livermore, spoke in support of the Unified Concept.

Rachael Snedecor, Livermore, spoke in support of the Unified Concept.

Colin Ponce spoke in support of more housing in the Downtown and Livermore that meet a variety of income levels.

Brooke Witherspoon, Livermore, First Street Ale House, spoke regarding a focus on parking, traffic flow and the accessibility of First, Second and Third Streets.

Liz Roberts, President, Livermore Downtown Inc. Board of Directors, spoke in support of the Unified Concept.

Maryann Brent, Livermore, spoke in support of a hotel on the west side.

Chris Chandler, Executive Director, Livermore Valley Wine Growers Association, spoke in support of the Unified Concept vision and a hotel next to the Bankhead Theater.

Rifka Several, Las Positas College, spoke in support of a west side hotel.

Dave David, Livermore, Fertile Groundswork, spoke in support of the Unifed Concept.

Andrew Barker, Livermore, spoke regarding the use of affordable housing funds.

Josh Kauman, member of younger demographic of Livermore, spoke regarding housing needs as a priority over parking.

Kelsey Tresemer, Livermore, said she was impressed by the outreach process, the need for affordable housing and in support of the Unified Concept.

Lee Ellison, spoke in support of affordable housing over parking.

Patricia Munro, spoke in support of the Unified Concept and the effect of Lyft and Uber on future parking needs.

Vaughn Dragoo, spoke in support of the science learning center and the Unified Concept.

Karl Wente, Livermore, spoke in support of the Unified Concept.

Tom Jefferson, Livermore, spoke in support of a west side hotel that would not require an underground parking garage.

Jacob Anderson, Livermore, spoke in support of prioritizing workforce housing.

Donna Cabanne, Sierra Club Tri-Valley Group Leader, said the west side hotel would provide the most open space and offered the best potential for affordable housing.

Tamera Reus, Livermore, said the entire project needed to be planned, the location of the hotel was important and supported a west side hotel.

Cal Wood, Livermore, spoke regarding Interfaith Housing for seniors and Interfaith was the right group to do the low-cost housing for seniors.

Ian O'Leary, Livermore Valley Wine Growers Association, spoke in support of the Unified Concept vision.

Derek Eddy, Purple Orchid Resort and Spa, Livermore, spoke regarding the need for a boutique hotel.

Tom O'Neil, Livermore, spoke about the discrepancy regarding housing as a priority in contrast to the survey results, which showed housing as a last priority.

Laning Thompson, President, Interfaith Housing, spoke in support of a downtown park for the Stockmen and the Unified Concept.

Jean King, Livermore, said the community group has made revisions to their plan and requested the Council direct City staff to review the new plan.

David Rounds, Livermore, spoke regarding the outreach process and the plans submitted by the Community Group and Unified concept.

Linda Randall, Livermore, spoke in support of a west side hotel and affordable housing especially for seniors.

Elizabeth Judge, Livermore, said the younger generation did not provide on-line input to support housing; she supported the Stockmen's proposal.

Richard Ryon, Livermore, spoke in support of a hotel on the west side, the Stockmen's proposal, and other proposed locations for housing.

Shelan Zuhdi, San Francisco Bay Chapter Sierra Club, spoke in support of a west side hotel, public open space and affordable housing.

Michael Fredrick, Livermore, spoke in support of the Stockmen's proposal and a west side hotel not on L Street.

Lynn Seppala, Livermore, spoke in support of the Community Group plan and the entire plan being done at the same time.

Jan Brovant, Livermore, spoke in support of a hotel on the west side; more parking by the Bankhead and the southwest side of the Lucky site, and the Stockmen's proposal.

Bill Dunlop, Livermore, spoke in support of a science center, a west side hotel, and the Stockmen's proposal.

Sally Dunlop, Livermore, spoke in support of the Stockmen's proposal and mentioned locations of housing developments in other areas of the city.

Stephanie Fish, Blacksmith Square, read a letter from business owners, managers and employees of Blacksmith Square supporting the City's program to connect Blacksmith Square with the rest of the downtown; and spoke in support of the Unified Concept plan.

Rakesh Patel, Presidio, spoke regarding various locations for hotels on both the east and west side.

Joan Green, Livermore, said she agreed with Jean King's comments.

Evonne Hopkins, requested that planning for infrastructure in support of tourism groups be included in the Downtown plan.

Larry Dino, Livermore, spoke of the urgency and need for a luxury hotel on the east side.

Dawn Argula, CEO and President, Livermore Chamber of Commerce, spoke in support of a unified plan for a dynamic, diverse and thriving Downtown.

Chester Moore, Livermore, spoke regarding the importance of the central block of the Downtown and his recommendation for the Downtown plan.

Doug Mann, Livermore, said the City needed to continue to gather information as some people were just learning about the plan.

Milo Nordyke, Livermore, said the location of the hotel was a key question. He supported the location of the hotel on the west side.

Tom Manger, President, Robot Garden Makerspace, spoke in support of the Unified Concept and the development of a science center.

John Stein, Livermore, said conceptual plans needed to be presented to the community prior to detailed project plans being developed.

Jeff Kaskey, Livermore, Community Group, presented the latest version of the Community Group plan.

Ian Karlin, Livermore, spoke regarding the environmental impact the project would have, and in support of housing in the Downtown.

Alexandra Felker, Livermore, said a boutique hotel was important, there was a great need for affordable housing, and agreed with the Unified Concept.

Drew Felker, Livermore, spoke in support of downtown affordable housing and the need to establish a timeline for the project.

Arlynn Grimm, Livermore, spoke in support of a hotel on L Street, and a parking garage on the Groth Brothers lot or at the Tri-Valley Haven resale shop. She supported the Stockmen's proposal and no housing in the Downtown.

Denise Leddon, Livermore, supported a west side hotel and green space, the Stockmen's proposal, and encouraged review of the new community group plan.

Laurie Soucie, Livermore, supported a west side hotel, the community group plan, and no housing in the Downtown.

Wolf Hamlin, Livermore, spoke regarding working together and moving forward with the Downtown plan.
