1. CALL TO ORDER/PLEDGE OF ALLEGIANCE The meeting of the City Council was called to order by Mayor John Marchand at 7:08 pm, in the City Council Chambers, 3575 Pacific Avenue, Livermore, California.

1.01 ROLL CALL Present: Mayor John Marchand, Vice Mayor Bob Woerner, and Council Members Stewart Gary, Doug Horner, and Laureen Turner.

1.02 PLEDGE OF ALLEGIANCE

2. PROCLAMATIONS AND PRESENTATIONS

2.01 Library Board of Trustees Annual Update.

Library Board of Trustees member David Runyon presented the annual update.

2.02 Proclamation honoring the West Coast Soccer Club.

Mayor Marchand presented the proclamation honoring the West Coast Soccer Club to club President Troy Dayak.

2.03 Proclamation recognizing the City of Livermore as a California Safe Digging City.

Mayor Marchand presented the proclamation recognizing the City of Livermore as a California Safe Digging City to Roxanne Cruz of Pacific Gas and Electric Company.

2.04 Proclamation honoring the 25th Anniversary of the Altamont Cruisers Nostalgia Day Car Show.

Mayor Marchand presented the proclamation honoring the 25th Anniversary of the Altamont Cruisers Nostalgia Day Car Show to club President John Buczeke.

2.05 Proclamation honoring the 40th Anniversary of the Twin Valley Learning Center.

Mayor Marchand presented the proclamation honoring the 40th Anniversary of the Twin Valley Learning Center to Executive Director Mary Perner.

Mayor Marchand recognized former mayor John Shirley on his 90th birthday (in absentia).

2.06 Proclamation honoring Council Member Doug Horner.

Mayor Marchand presented the proclamation to Council Member Doug Horner thanking him for dedicated service and contributions to the Livermore community.

Lee Yonker, Friends of Livermore, thanked Council Member Doug Horner for his years of service on the City Council.

Assembly Member Joan Buchanan, District 16, presented a certificate of appreciation from the State Assembly to Council Member Doug Horner.

John Thurman, representing Alameda County Supervisor Scott Haggerty, presented a proclamation honoring and thanking Council Member Doug Horner for his service.

Josh Huber, representing Congressman Eric Swallwell, expressed thanks and appreciation to Council Member Doug Horner.

CM Horner shared memories of his terms of office from his original appointment to the Design Review Committee, to the Planning Commission and appointment to the City Council. He expressed thanks and appreciation to those who he had worked with throughout the past years.

VM Woerner expressed his thanks and appreciation to Council Member Horner.

CM Gary said Council Member Doug Horner was the epitome of service above self.

CM Turner said what she like best about Council Member Horner was he didnt open his mouth unless he had something very meaningful to say so people listened.

Mayor Marchand presented a plaque to Vice Mayor Woerner in appreciation of serving as his right-hand man for the past year.

Jamario Jackson, representing Assembly Member Susan Bonilla, congratulated the newly elected mayor and council members and presented a certification of appreciation to outgoing Council Member Doug Horner for his service and dedication.

3. CITIZENS FORUM

Judy Galletti, Livermore, spoke regarding comments and responses made at prior council meetings.

Chris Pareja, Livermore, clarified comments he made at the last council meeting, Measure BB, the lack of snow at Lizzie Fountain as part of the holiday parade.

In response to questions by Mayor Marchand, City Manager Marc Roberts said Livermore Downtown Inc. sponsored and paid for the parade and snow at Lizzie Fountain in prior years.

CM Gary said the company that made the snow notified Livermore Downtown Inc. that a tremendous amount of water was needed to make the snow and due to the drought, they did not want to be associated with the event.

Mary Jo Rittman, Pleasanton, spoke regarding tree preservation and the Citys tree permit policy.

Don Meeker, Livermore, spoke regarding the City seal.

Betty Murillo, Livermore, spoke regarding the problems caused by the overabundance of geese at the Springtown Golf Course.

Troy Brown, Livermore, spoke regarding Jenny Haruyama, the Citys new assistant city manager.

City Manager Marc Roberts introduced Assistant City Manager Jenny Haruyama.

4. CONSENT CALENDAR

ON THE MOTION OF CM GARY, SECONDED BY VM WOERNER, AND CARRIED ON A 5-0 VOTE, THE CITY COUNCIL APPROVED THE CONSENT CALENDAR WITH THE EXCEPTION OF ITEM 4.04.

4.01 Adoption of Ordinance 2013 amending the Zoning District Map of the City of Livermore (Development Code Amendment 14-001 Home2 Suites).

4.02 Introduction of an omnibus ordinance to update, clarify, and revise existing sections of the Livermore Municipal Code.

4.03 Resolution 2014-201 approving the Annual Report on Development Fee Revenues and Expenditures for Fiscal Year 2013-2014.

4.04 Resolution accepting for permanent maintenance and releasing of security for the Galaxy Court Flood Protection and Trail Culvert Replacement, Project No. 2010-29.

ITEM 4.04 WAS REMOVED FROM THE AGENDA.

4.05 Resolution 2014-202 authorizing execution of the Subdivision Improvement Agreement; approving Tract 7840 Final Map for recording; and accepting on behalf of the public all real property offered for dedication within Tract Map 7840, in conformance with the terms of the offer, except for the following, reserving the right to accept the offer at a future date: Public Utility Easements, and Emergency Vehicle Access Easement.

4.06 Resolution 2014-203 authorizing execution of the Subdivision Improvement Agreement; approving Tract 7870 Final Map for recording; and accepting on behalf of the public all real property offered for dedication within Tract Map 7870, Brisa Station Phase 1.

4.07 Resolution 2014-204 accepting public improvements completed under encroachment permit EN100331, accepting on behalf of the public all real property offered for dedication within Parcel Map 9992. (Las Positas Road)

4.08 Resolution 2014-205 accepting Tract 8061 public improvements for permanent maintenance, and accepting on behalf of the public all real property offered for dedication within Tract 8061. (Central Avenue)

4.09 Resolution 2014-206 summarily vacating a portion of Isabel Avenue and Voyager Street; Resolution 2014-207 authorizing the sale/disposition and execution of a Grant Deed transferring to Livermore Oaks Joint Venture, LLC; authorizing execution of an Amendment to grant an easement for access; authorizing execution of the Subdivision Improvement Agreement; and Resolution 2014-208 approving Final Map 10266 for recording; and accepting on behalf of the public all real property offered for dedication within Parcel Map 10266.

4.10 Resolution 2014-209 authorizing execution of an agreement with Pacific - Mountain Contractors of California Inc., in the amount of $3,452,489, for construction of the Livermore-Pleasanton Fire Station No. 9, Project No. 1994-55.

6. COUNCIL COMMITTEE REPORTS AND MATTERS INITIATED BY CITY MANAGER, CITY ATTORNEY, STAFF, AND COUNCIL MEMBERS. None.

7. MATTERS FOR CONSIDERATION

7.01 Resolution accepting canvass of votes of the General Municipal Election of November 4, 2014.

The following persons were elected to the respective office for the terms stated:

John Marchand, Mayor Two-year term

Steven Spedowfski, Council Member Four-year term

Bob Woerner, Council Member Four-year term

The following measures were passed:

Recommendation: Staff recommended the City Council adopt the resolution accepting the canvass of votes as certified by the Alameda County Registrar of Voters.

ON THE MOTION OF CM HORNER, SECONDED BY CM TURNER AND CARRIED ON A 5-0 VOTE, THE CITY COUNCIL ADOPTED THE FOLLOWING RESOLUTION:

Resolution 2014-120 accepting canvass of votes of the general municipal election of November 4, 2014.

ORDINANCES 2014 AND 2015 TO BE EFFECTIVE DECEMBER 18, 2014:

Ordinance 2014 to add Subsection D to Section 2.04.030, Compensation Limits for Mayor and Council Members, to the Livermore Municipal Code.

Ordinance 2015 to add Section 2.04.030.5, No City Paid Health-and-Welfare benefits for Mayor and Council Members, to the Livermore Municipal Code.

City Clerk Susan Neer administered the oath of office to John Marchand, Steven Spedowfski, and Bob Woerner.

9. CALL TO ORDER OF NEWLY INSTALLED COUNCIL

9.01 ROLL CALL Present: Mayor John Marchand and Council Members Stewart Gary, Laureen Turner, Steven Spedowfski, and Bob Woerner.

10. CITIZENS FORUM

Beth Patock, representing Assembly Member Catherine Baker, thanked Doug Horner for his service and expressed congratulations to the incoming mayor and council members.

Don Meeker, Livermore, spoke regarding the history of Livermore and a publication from 1892 titled Illustrated Album of Alameda County, California.

11. MATTERS FOR CONSIDERATION

11.01 Approval of the City Council/Successor Agency Meeting Calendar for 2015.

Recommendation: Staff recommended the City Council/Successor Agency approve the meeting calendar for 2015.

ON THE MOTION OF CM GARY, SECONDED BY CM WOERNER AND CARRIED ON A 5-0 VOTE, THE CITY COUNCIL APPROVED THE MEETING CALENDAR FOR 2015.

11.02 Appointment of Vice Mayor.

Recommendation: Staff recommended the Mayor appoint a Vice Mayor.

Mayor Marchand appointed Council Member Laureen Turner to serve as Vice Mayor.

11.03 Appointment of Council Members to Intergovernmental Agencies.

Recommendation: Staff recommended the Mayor make the appointments.

11.04 Appointment of Council Members to the City Council Subcommittee to conduct Advisory Body interviews from January 1 June 30, 2015, including the Livermore Area Youth Advisory Commission.

Recommendation: Staff recommended two Council Members be appointed to serve on the City Council Subcommittee for Advisory Bodies.

Mayor Marchand and CM Gary were appointed to the City Council Subcommittee.

11.05 Discussion and direction regarding pending State or Federal legislation. None.

12. COUNCIL COMMITTEE REPORTS AND MATTERS INITIATED BY CITY MANAGER, CITY ATTORNEY, STAFF AND COUNCILMEMBERS

12.01 Council Committee Reports and Matters Initiated by City Manager, City Attorney, Staff, and Councilmembers.

Oversight Board CM Gary said he attended the December 3, 2014, Oversight Board meeting.

Holiday Parade VM Turner said she, along with other members of the Council, attended the Lights and Sounds Holiday Parade on December 6, 2014.

Tri-Valley Community Television Mayor Marchand said on December 1, 2014, he attended the board meeting. There was a discussion on the operations and budget for 2015.

Livermore Cultural Arts Council Mayor Marchand said on December 3, 2014, he attended the meeting. There was a discussion on the calendar of upcoming events.

Deacon Daves Mayor Marchand said on December 5, 2014, he attended the lighting ceremony at Casa del Pomba. There were over 304,000 lights this year.

Stuff a Bus Mayor Marchand said on December 6, 2014, he attended the event.

Airport Commission Mayor Marchand said on December 8, 2014, he attended the Commission meeting. He said there was discussion on limiting the number of hangars that a business could own.

Menorah Lighting Mayor Marchand said the 7th annual Menorah Lighting would be held at Shea Plaza on December 20, 2014.
